A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the term of an easement granted by the Parks and |
|
|
Wildlife Commission to an electric cooperative for certain state |
|
|
land. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 11.301, Parks and Wildlife Code, is |
|
|
amended by adding Subsection (d) to read as follows: |
|
|
(d) An easement on state land managed by the department that |
|
|
is granted by the commission to an electric cooperative as defined |
|
|
by Section 161.002, Utilities Code, shall be in perpetuity. |
|
|
SECTION 2. Section 11.301(d), Parks and Wildlife Code, as |
|
|
added by this Act, applies only to an easement granted on or after |
|
|
the effective date of this Act. An easement granted before the |
|
|
effective date of this Act is governed by the law in effect on the |
|
|
date the easement was granted, and the former law is continued in |
|
|
effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
