A JOINT RESOLUTION
|
|
proposing a constitutional amendment to repeal the constitutional |
|
provision providing that marriage in this state consists only of |
|
the union of one man and one woman and prohibiting this state or a |
|
political subdivision of this state from creating or recognizing |
|
any legal status identical or similar to marriage, and to change |
|
certain terminology used to refer to the parties to a marriage. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 32, Article I, Texas Constitution, is |
|
repealed. |
|
SECTION 2. Section 52, Article XVI, Texas Constitution, is |
|
amended to read as follows: |
|
Sec. 52. On the death of one [the husband or wife,] or both |
|
spouses, the homestead shall descend and vest in like manner as |
|
other real property of the deceased, and shall be governed by the |
|
same laws of descent and distribution, but it shall not be |
|
partitioned among the heirs of the deceased during the lifetime of |
|
the surviving spouse [husband or wife], or so long as the survivor |
|
[surviver] may elect to use or occupy the same as a homestead, or so |
|
long as the guardian of the minor children of the deceased may be |
|
permitted, under the order of the proper court having the |
|
jurisdiction, to use and occupy the same. |
|
SECTION 3. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 4, 2025. |
|
The ballot shall be printed to permit voting for or against the |
|
proposition: "The constitutional amendment repealing the |
|
constitutional provision providing that marriage in this state |
|
consists only of the union of one man and one woman and prohibiting |
|
this state or a political subdivision of this state from creating or |
|
recognizing any legal status identical or similar to marriage, and |
|
changing certain terminology used to refer to the parties to a |
|
marriage." |
