FISCAL NOTE, 89TH LEGISLATIVE REGULAR SESSION

March 30, 2025

TO:
Honorable Jeff Leach, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB421 by González, Mary (relating to the creation of certain explicit deep fake material; providing a private cause of action.), Committee Report 1st House, Substituted

The fiscal implications of the bill cannot be determined due to a lack of case-level data.

The bill would create a new chapter in the Business and Commerce Code requiring deep-fake generators to verify the age of persons depicted by explicit deep fake materials and to prohibit the depiction of minors. The bill would also require deep-fake generators to obtain consent from persons depicted in explicit materials. The bill would create a private cause of action for violations of the chapter.

According to the Office of Court Administration, the fiscal implications cannot be determined since case volume cannot be projected with existing data.

Local Government Impact

The fiscal implications of the bill cannot be determined at this time.
