Jerry McGinty, Director, Legislative Budget Board
IN RE:
HB525 by Vasut (Relating to a subpoena to compel the attendance of certain peace officers who are witnesses in a misdemeanor case punishable by fine only.), As Introduced
No significant fiscal implication to the State is anticipated.
The bill would amend Code of Criminal Procedure to allow the state or a defendant to subpoena a peace officer who is a witness residing outside the county in a misdemeanor case punishable only by a fine. Cases punishable by fine are only filed in justice and municipal courts.
According to the Office of Court Administration, no significant fiscal impact to the state court system is anticipated, as these cases are filed in local courts.
Local Government Impact
The fiscal impact cannot be determined because there is no data available to project the number of officers who will be subpoenaed in future or pending cases. Courts do not report the number or type of witnesses subpoenaed in a case.
