No significant fiscal implication to the State is anticipated.
The bill would create the new offense of violation relating to overflow caused by diversion of water, committed when a person diverts or impounds, or permits the diversion or impoundment of the natural flow of surface waters in a manner that damages the property of another by the overflow of the water diverted or impounded.
The offense would be punishable as a Class C misdemeanor for a first time offense and as a Class B misdemeanor for a subsequent offense. It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.
While it is assumed that any state revenue impact would not be significant, it would be dependent on the number of offenses committed and the associated court costs.
Local Government Impact
It is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant.
