LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 89TH LEGISLATIVE REGULAR SESSION

April 27, 2025

TO:
Honorable Ken King, Chair, House Committee on State Affairs

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB1554 by Capriglione (Relating to a political subdivision's authority to use public money in the provision of legal services for individuals unlawfully present in the United States.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would prohibit the use of public funds by governmental entities, including political subdivisions, for providing legal services to individuals unlawfully present in the U.S. in a removal or immigration-related civil proceeding, unless required by the U.S. constitution.

Local Government Impact

The impact to local governments cannot be determined at this time because the extent to which local governments are currently using funds for this purpose is unknown. To the extent that political subdivisions are using public money for the provision of legal services to individuals unlawfully present in the United States, there would savings to political subdivisions associated with the prohibition against such use proposed by the bill.
