LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 89TH LEGISLATIVE REGULAR SESSION

April 29, 2025

TO:
Honorable Ken King, Chair, House Committee on State Affairs

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB1617 by Swanson (Relating to exempting the intrastate manufacture of a firearm, a firearm accessory, or ammunition from federal regulation.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would exempt the manufacture of firearms, firearm accessories, and ammunition that occurs in Texas from being subject to federal law. A Texas citizen may notify the Office of the Attorney General (OAG) of their intent to manufacture a firearm, firearm accessory, or ammunition in Texas. If this occurs, the OAG would be required to seek a judgement from a federal district court that the bill is consistent with the U.S. Constitution.

The OAG anticipates a possible increase in legal work would occur as a result of the bill. However, the agency assumes any additional legal work could reasonably be absorbed using existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
