Because the number of permits that would be issued and the fee that would be assessed for each permit under the provisions of the bill is unknown, the potential revenue gain to the State Highway Fund cannot be estimated at this time.

The bill would allow the Texas Transportation Commission to authorize the City of Roma to issue permits and collect permit fees, not to exceed $200 per trip, for the movement of oversize or overweight vehicles carrying cargo on specific roadways in Starr County. The bill would stipulate that the fee revenue may be used only for the operation and maintenance of roadways specified in the bill and for the city's administrative costs, which may not exceed 15 percent of the fees collected. The bill would specify the allocation of fees collected, less the city's administrative costs, between the city and the State, and require the State's portion to be sent to the Comptroller for deposit to the State Highway Fund. The bill would require the Texas Department of Transportation (TxDOT) to create a pavement management plan for the roadways specified in the bill. The bill would take effect on September 1, 2025.

Note: This legislation would do one or more of the following: create or recreate a dedicated account in the General Revenue Fund, create or recreate a special or trust fund either in, with, or outside the Treasury, or create a dedicated revenue source. The fund, account, or revenue dedication included in this bill would be subject to funds consolidation review by the current Legislature.

Because the number of permits that would be issued by the City of Roma and the fee that would be assessed for each permit is unknown, the potential revenue gain to the State Highway Fund cannot be estimated at this time. Based on the information provided by TxDOT, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within current resources and the portion of permit fee collections allocated to the State Highway Fund.

Local Government Impact

Because the number of permits that would be issued by the City of Roma and the fee that would be assessed for each permit is unknown, the potential revenue gain to the city cannot be estimated at this time. It is assumed the portions of permit fee collections allocated to the city would offset costs to the city to implement the provisions of the bill.
