No significant fiscal implication to the State is anticipated.

The bill would modify the definition of telephone solicitation to include transmissions of text messages, graphic messages, or images. The bill would make violations of the Business and Commerce Code Chapters 304, Telemarketing, and 305, Telephonic Communications Made for the Purpose of Solicitation, a deceptive trade practice. Public remedies for deceptive trade practices could include civil penalties.

Any revenue impact would be dependent on the number of violations that result in a civil penalty. Because of the unknown number of violations that may occur, the revenue impact of the bill cannot be determined. 

It is assumed that any costs associated with the bill could be absorbed using existing resources.
