LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 89TH LEGISLATIVE REGULAR SESSION

March 23, 2025

TO:
Honorable Pete Flores, Chair, Senate Committee on Criminal Justice

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB1637 by King (Relating to an exception to the application of the offense of deadly conduct for certain peace officers discharging official duties.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would make an exception to the application of the offense of deadly conduct if the actor at the time of the offense was engaged in the actual discharge of official duties as a peace officer and if the actor reasonably believed the conduct was necessary for self-defense or defense of a third person. It is assumed that any fiscal impact and any impact on state correctional populations or on the demand for state correctional resources would not be significant.

Local Government Impact

It is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant.
