No significant fiscal implication to the State is anticipated.
The bill would increase the criminal penalty for the offense of assault from a Class C misdemeanor to a Class B misdemeanor if the actor threatens to assault or causes physical contact of an offensive nature with a person who is a peace officer, a community supervision and corrections department officer, a parole officer, or an emergency services personnel while the person is performing certain duties.
The bill would expand the conduct constituting the Class B misdemeanor offense of interference with public duties by including the interference or disruption of a person who is a community supervision and corrections department officer or a parole officer while the person is performing certain duties.
The bill would amend certain presumptions related to these offenses.
It is assumed that any fiscal impact and any impact on state correctional populations or on the demand for state correctional resources would not be significant.
Local Government Impact
It is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant.
