LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 89TH LEGISLATIVE REGULAR SESSION

April 9, 2025

TO:
Honorable Bryan Hughes, Chair, Senate Committee on State Affairs

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB2742 by Hagenbuch (Relating to prohibiting electioneering and the unlawful use of public funds for political advertising, authorizing a civil penalty.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would prohibit the board of trustees of an independent school district from using state or local funds or other district resources to advocate for or against a candidate, measure, or political party. The bill would also add provisions to the Election Code regarding political advertising by officers or employees of political subdivisions. The bill would authorize the Office of the Attorney General to pursue civil penalties for violations of these provisions.

It is assumed that any costs associated with the bill could be absorbed using existing resources.

It is also assumed any revenues collected from civil penalties would have an insignificant fiscal impact.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
