LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 89TH LEGISLATIVE REGULAR SESSION

February 12, 2025

TO:
Honorable Pete Flores, Chair, Senate Committee on Criminal Justice

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SJR1 by Huffman (proposing a constitutional amendment requiring the denial of bail for an illegal alien charged with an offense punishable as a felony.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated, other than the cost of publication.

The cost to the state for publication of the resolution is $191,689.

The joint resolution would propose an amendment to Article I of the Texas Constitution to deny bail pending trial for illegal aliens accused of committing a felony offense where a judge or magistrate has determined probable cause.

It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.

Local Government Impact

According to information provided by the Office of Court Administration, the resolution could generate additional hearings before bail can be denied and could also increase jail populations, resulting in increased but indeterminate costs to applicable units of local government.
