IN RE:	HB1871 by Dyson (Relating to the punishment for the criminal offense of attempted capital murder of a peace officer; increasing a criminal penalty; changing eligibility for parole and mandatory supervision.), As Engrossed

The bill would modify the punishment for the offense of attempted capital murder of a peace officer acting in the line of duty to be a first degree felony punishable by life imprisonment or a term of not more than 99 years or less than 25 years. The bill would also make the offense ineligible for community supervision or release onto parole.

Increasing the penalty for an existing offense may result in additional demands upon state correctional resources due to a possible increase in the number of individuals confined and in the length of stay for individuals sentenced to a term of confinement.

In fiscal year 2024, there were 20 arrests, no referrals, no placements onto community supervision, and 7 individuals admitted into an adult state correctional facility for the offense of capital murder of a peace officer or fireman.
