Honorable Gary Gates, Chair, House Committee on Land & Resource Management
FROM:
Jerry McGinty, Director, Legislative Budget Board
IN RE:
HB3680 by Gámez (Relating to subdivision plat requirements in certain counties.), As Introduced
The bill would create Class A misdemeanor offenses relating to the advertising standards and requirements before the sale of subdivided land and to the responsibilities of county commissioners. The bill would furthermore create offenses relating to the responsibilities of subdividers where the criminal penalty is a Class A misdemeanor or a state jail felony dependent on certain conditions.
Creating new criminal offenses may result in an increase in demands upon state and local correctional resources due to a possible increase in the number of individuals placed under supervision in the community or sentenced to a term of confinement.
It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.
