SB2753 by Hall (Relating to the time, place, and manner of voting, including abolishing early and absentee voting, providing for a voting period, and establishing voting centers; reestablishing criminal offenses and authorization for certain fees.), As Introduced

The bill would create the state jail felony offense of fraudulent use of application to vote by mail. The offense would be increased to the next higher category if it is shown on the trial that the defendant has been previously convicted of an Election Code offense, if the offense involved a vote 65 years of age or older, or if the defendant committed another offense under that section in the same election.

Creating a new criminal offense may result in an increase in demands upon state and local correctional resources due to a possible increase in the number of individuals placed under supervision in the community or sentenced to a term of confinement.

In fiscal year 2024, there were 22 arrests, no referrals, 1 placement onto adult community supervision, no individuals admitted into an adult state correctional facility, and no individuals admitted into a juvenile state correctional facility for any offense under the Election Code.

It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.
