SB2949 by Hinojosa, Juan "Chuy" (relating to the regulation of certain facilities and operators engaged in the motor fuel transport or export business; requiring an occupational license; authorizing a fee; creating criminal offenses; authorizing a civil penalty.), Committee Report 2nd House, Substituted

The bill would expand conduct constituting existing offenses and create new offenses relating to the transportation of motor fuel or hazardous materials and make them punishable across a penalty range from a third degree felony to second degree felony depending on the offense and offense circumstances. The bill would expand the conduct constituting the offense related to motor fuel tax to include the transferring of motor fuel purchased for export or the operation of an export fuel transloading facility under certain circumstances punishable by a third degree felony.

Creating new criminal offenses and expanding the conduct constituting existing offenses may result in an increase in demands upon state and local correctional resources due to a possible increase in the number of individuals placed under supervision in the community or sentenced to a term of confinement. 

In fiscal year 2024, there were 113 arrests, no referrals, 19 placements onto adult community supervision, 10 individuals admitted into an adult state correctional institution, and no individuals admitted into a juvenile state correctional institution for offenses relating to motor fuel tax. 

In fiscal year 2024, there were 4 arrests, no referrals, no placements onto adult community supervision, no individuals admitted into an adult state correctional institution, and no individuals admitted into a juvenile state correctional institution for offenses relating to vehicle size and weight. 

It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.
