SB2949 by Hinojosa, Juan "Chuy" (Relating to the regulation of the transportation of motor fuels and other hazardous materials; creating a criminal offense.), As Introduced

The bill would expand conduct constituting the second degree felony offense relating to cargo manifests and the transportation of motor fuel by including transporting motor fuel without a cargo manifest or shipping document or presenting a shipping document inconsistent with the volume and content of the motor fuel being transported. The bill would furthermore create a second degree felony offense of operation of an overweight vehicle transporting hazardous materials on a route on a public highway that is not designated by the permit as a path of travel. 

Creating a new criminal offense and expanding the conduct constituting an existing offense may result in an increase in demands upon state and local correctional resources due to a possible increase in the number of individuals placed under supervision in the community or sentenced to a term of confinement. 

In fiscal year 2024, there were 113 arrests, no referrals, 19 placements onto adult community supervision, 10 individuals admitted into an adult state correctional institution, and no individuals admitted into a juvenile state correctional institution for offenses relating to motor fuel tax. 

In fiscal year 2024, there were 4 arrests, no referrals, no placements onto adult community supervision, no individuals admitted into an adult state correctional institution, and no individuals admitted into a juvenile state correctional institution for offenses relating to vehicle size and weight. 

It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.
